Studio Sim terms of use

The game

Studio Sim is a work of entertainment about operating a game studio. Names, projects, reviews, and studio events in the game are fictional or simulated. The title is a working name and may change before release.

Licence

Flamewave Studios grants you a personal, non-exclusive, non-transferable, revocable licence to download and play Studio Sim on Apple devices you own or control, in line with Apple’s App Store rules. We retain all other rights in the game, including art, names, fictional issuers, audio, code, and the Flamewave name.

In-app purchases and virtual items

If the game offers in-app purchases, those purchases are billed by Apple under your Apple ID terms. Virtual currency, items, and unlocks have no real-world cash value, cannot be redeemed with us for money, and may be lost if you delete the app, change devices without a transfer method, or if we reasonably withdraw an item.

Refunds, if any, are handled by Apple according to Apple’s refund policies, except where Australian Consumer Law gives you a non-excludable remedy against us.

Acceptable use

You must not cheat, attack, reverse engineer, or misuse the game in a way that harms other players or the studio, except to the extent that Australian or other applicable law allows reverse engineering for interoperability. You must not use the game to pretend it is a real brokerage or to solicit real investments.

Availability

The game is not released yet. Features described on the website may change or may never ship.

Apple App Store

If you download the game from the Apple App Store, the following terms also apply. In the event of a conflict between these Terms and Apple’s Licensed Application End User License Agreement, Apple’s terms control to the extent required by Apple.

You acknowledge that these Terms are between you and Flamewave Studios, not Apple. Flamewave Studios, not Apple, is responsible for the game and its content. Apple has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation. Flamewave Studios, not Apple, is responsible for addressing claims relating to the game, including product liability, legal or regulatory failure, and consumer protection claims. Apple is a third-party beneficiary of these Terms and may enforce them against you.

If the game fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price of the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the game.

Disclaimers

To the maximum extent permitted by law, Studio Sim is provided as-is. We do not promise that a simulation will be free of bugs, that a session will feel fair, or that a fictional market will match any real one.

Australian Consumer Law

If you are a consumer in Australia, you have rights under the Australian Consumer Law that cannot be excluded, restricted or modified. Nothing in these Terms excludes, restricts or modifies those rights, including consumer guarantees as to acceptable quality and due care and skill.

Where we are permitted to limit our liability for a breach of a consumer guarantee, and it is fair and reasonable to do so, our liability is limited to resupplying the game or paying the cost of resupply.

Liability

To the maximum extent permitted by law, and subject to the Australian Consumer Law section above, Flamewave Studios is not liable for indirect or consequential loss, or for loss of simulated profits. Our total liability arising out of the game is limited to the amount you paid for the app and any in-app purchases in the three months before the claim, or AUD $50 if you paid nothing, whichever is higher — unless a non-excludable law requires more.

Changes to these terms

We may update these terms for a new version of the game. The date at the top will change. If you continue to play after an update, the new terms apply to that version.

Governing law

These terms are governed by the laws of Australia. You may also have mandatory consumer protections in the place where you live.
